These Terms and Conditions ("Terms") govern your access to and use of the TheBigs application, website, and related services (collectively, the "Service"). The Service is operated by Balihoo Productions, Inc. ("TheBigs," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and is responsible for your use of the Service.

You understand that the Service is designed to support training execution and consistency, but it does not guarantee any specific result.
If you join a team or connect with a coach through the Service, additional features may be available, such as:
Coach-assigned team sessions may be view-only and may not be editable, swappable, or marked complete by athletes within the app, depending on how your team is configured.
If messaging is enabled, you agree to use it responsibly. Messaging is intended for training-related coordination and constructive communication. We may provide moderation tools and may remove content or restrict accounts that violate these Terms.
The Service provides general training and informational content. It is not medical advice, and it is not a substitute for professional medical evaluation, diagnosis, treatment, or rehabilitation.
You should consult a qualified healthcare professional before starting any new training program, especially if you have a medical condition, injury history, pain, or other health concerns.
If any activity causes pain, dizziness, shortness of breath beyond normal exertion, or other concerning symptoms, stop immediately and consult a qualified professional.
Athletic training involves inherent risks (including serious injury). You voluntarily assume all risks associated with your participation and use of the Service.
If the Service includes paid features, subscription plans, or in-app purchases, pricing and billing terms will be presented at the time of purchase.
If you purchase through the Apple App Store, Google Play, or another platform, billing, renewal, cancellation, and refund terms are governed by that platform's policies in addition to these Terms.
We may change pricing or plans going forward. If changes apply to an ongoing subscription, we will provide notice as required by applicable law and platform rules.
"User Content" includes information you submit or generate through the Service, such as readiness inputs, logs, messages, notes, photos, or other content. You retain ownership of your User Content as between you and TheBigs, subject to the license below.
You grant TheBigs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content only as needed to operate, improve, and provide the Service, including sharing content with people you authorize (for example: your coach or team staff if you join a team).
If you join a team, you understand that your training activity, readiness status, and logs may be visible to your team staff, coaches, and administrators as part of the Service.
We may remove or restrict access to User Content that violates these Terms, is unlawful, or creates risk to users or the Service.
You agree not to:
We may suspend or terminate accounts that violate these rules.
The Service, including all software, design, text, graphics, logos, and training templates and content (excluding User Content), is owned by TheBigs or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use (or internal team use if you are a coach/admin using authorized team features). You may not reproduce, distribute, or create derivative works from the Service content unless expressly permitted in writing.
Your use of the Service is also governed by our Privacy Policy.
The Service may integrate with third-party services (for example: app stores, authentication providers, or analytics). Your use of those services may be governed by their own terms and privacy policies. We are not responsible for third-party services outside our control.
You may stop using the Service at any time. If you have a subscription, you must cancel through the platform where you purchased (for example: App Store or Google Play), unless we clearly provide another method.
We may suspend or terminate your access if we reasonably believe:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that any particular training outcome will be achieved.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEBIGS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO THEBIGS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.00
You agree to indemnify and hold harmless TheBigs and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
We may update these Terms from time to time. If we make material changes, we will provide notice as required by applicable law. Your continued use of the Service after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of the United States of America, without regard to conflict of law rules.
Any dispute arising from these Terms or the Service will be resolved in Tennessee, USA unless applicable law requires otherwise.
